About these terms

Who am I renting from?

All charters are provided by SOFLO Ocean Escape Charters LLC, based in Boynton Beach, Florida. You can reach us at (561) 559-7975 or info@soflooceanescape.com.

When do these terms apply?

These Rental Terms & Policies apply to every charter booked with us. By submitting a booking request, the renter confirms that they have read and accepted them on behalf of everyone in their party. They are incorporated by reference into the onboard document you receive when your booking is confirmed. If anything here is unclear, please contact us before you book.

Who is the renter?

The renter is the person who submits the booking. The renter must be at least 18 years old on the day of the charter and is responsible for the conduct of everyone aboard, for the vessel during the charter, and for all amounts owed under these terms.

Booking & requirements

Is my booking confirmed immediately?

No. Every booking is a request until we confirm it. We check each request against our calendar — our boats are also listed on other booking platforms — and reply as quickly as possible. Your date is not reserved, and you are not charged, until we confirm.

When am I charged?

Your payment method is saved securely with our payment provider when you submit your request. The charter price, including add-ons and applicable sales tax, is charged only when we approve your request.

What information do you need from me?

Florida law requires us to record the renter's full name, home address and date of birth, the number of people aboard, and an emergency contact (name, address and phone number). We collect this when you book. If you rent without a captain, we also require a photo ID before departure.

Where does my charter start and end?

Every charter departs from and returns to Harvey E Oyer Jr Park, 2010 N Federal Hwy, Boynton Beach, FL 33435. Please arrive 15 minutes before your departure time for check-in. Your departure and return times are shown on your onboard document.

What are your operating hours?

Charters run from sunrise to sunset, roughly 6:30 AM–8:30 PM, with the last departure at 6:00 PM. Charters are booked in blocks of 3, 4, 6, 8 or 10 HR.

How many people can come aboard?

Up to 8 guests plus your captain, for a maximum of 9 people aboard. This limit may not be exceeded under any circumstances.

Cancellation, weather & refunds

Can I cancel my booking?

Yes. If you cancel more than 24 hours before your scheduled departure, you receive a full refund.

What if I cancel closer to the trip?

Cancellations made within 24 hours of departure, and no-shows, are not refundable. The only exception is a cancellation for unsafe weather, as described below.

What happens if the weather is unsafe?

We monitor the marine forecast for every charter. If we determine that conditions are unsafe — for example lightning, storms or high winds — we will contact you and cancel the charter, and you may choose either a full refund or a new date at no cost. The decision to cancel for weather is ours. Light rain or cloud cover alone is not grounds for a weather cancellation.

What if you cancel for another reason?

If we have to cancel because of a mechanical issue, you may choose either a full refund or a new date at no cost.

Incidentals hold

What is the $600 hold?

It is a temporary authorization hold on your card, placed before your trip. Your bank sets those funds aside while the hold is active, but they are not charged. After your trip we release the hold, or collect any applicable charges from it and release the rest. How quickly the release appears depends on your bank — usually a few business days.

When are charges collected from it?

When one of these policies applies: damage to the vessel or its equipment, lost or damaged items, running aground or striking bottom, late returns — whether or not they affect the next charter — towing or salvage costs, or excessive cleaning. We will always tell you what was charged and why.

Fuel & other charges

Is fuel included?

No. The renter pays for fuel. You pick up and return the boat at the ramp; after you leave, we refuel it and charge the exact fuel cost to your card on file, and email you a copy of the receipt. Fuel is not charged at checkout. The private tubing charter is the only exception: fuel is included in its price.

What if I return late?

Late returns are charged at $85 per 30 min after your trip, whether or not they affect the next charter.

Can I extend my charter?

Only if the boat is free after your charter — we cannot move other scheduled trips to make room. Ask us at least 1 hour before your scheduled return and we will tell you what is possible.

What if I run aground or hit bottom?

Any instance of running aground, striking bottom, or prop contact with sand/reef will incur a minimum $150 fee due to mechanical wear. Additional damage will be billed accordingly.

Who pays for damage?

Damage to the vessel or its equipment, and lost or damaged items, during the charter are charged to the renter. Charges are collected from the incidentals hold or charged to the card on file, and we will always tell you what was charged and why.

Operating the vessel

Can I rent without a captain?

Yes. When you rent without a captain, the renter operates the vessel and assumes full responsibility for its safe operation, for everyone aboard and for compliance with all applicable laws and navigational rules. Florida requires a FWC boating safety course to rent without a captain; you will be asked to confirm this when you request your date. Not sure? Add a captain.

What if I book a captain?

Our captain operates the vessel for the entire charter. Once your captain is assigned, we email you their name and phone number, and they appear on your onboard document.

Where can I take the boat?

Both SeaRay SPX boats must stay on the Intracoastal Waterway; taking either one through the inlet into the ocean carries a $100 fine. The Key West Center Console is the only boat allowed offshore, when conditions allow, and the only one on which fishing is permitted (the fish cleaning add-on is required when you fish).

Are life jackets provided?

Yes, for everyone aboard. Children's life jackets are available in a range of sizes: let us know at least 2 hours before your trip so we bring aboard the ones you need. Florida law requires children under 6 to wear a life jacket at all times while the vessel is underway.

Towing & salvage

Who pays for towing or salvage?

Renter is responsible for all towing, salvage, recovery, or other assistance charges resulting from the renter’s operation of the vessel, including but not limited to grounding, running aground, collision, operator error, or failure to follow navigational instructions, except to the extent caused by mechanical failure or circumstances outside the renter’s control.

Who do I call if I need a tow?

Call us first at (561) 559-7975. If you cannot reach us, contact TowBoatUS at +1 (561) 842-1525. In an emergency, call 911 or the US Coast Guard on VHF Channel 16.

Insurance

Who insures the vessel?

The vessel is insured by Concept Special Risks, 3940 Peninsular Dr SE, Ste 100, Grand Rapids, MI 49546-6107. Report any accident, damage or injury to us immediately at (561) 559-7975.

Safety & emergencies

What should I do in an emergency?

Call 911 for any emergency involving injury or danger to life. On the water you can also reach the US Coast Guard on VHF Channel 16. Then notify us at (561) 559-7975 as soon as it is safe to do so.

Add-ons, food & drink

How far ahead do I need to order snacks?

Snack packages require at least 48 hours' notice because they are prepared fresh. The booking form disables them automatically if your date is too close.

Can I bring my own food and drink?

Yes. Every boat has built-in coolers, so please leave external coolers at home — they damage the cushions. Everything brought aboard must leave with you.

Do the snack packages contain allergens?

Snack packages may contain or come into contact with common allergens. Guests are responsible for reviewing ingredients and informing us of any allergies or dietary restrictions before ordering. SOFLO Ocean Escape Charters is not responsible for allergic reactions or adverse effects resulting from consumption of provided snacks.

ID verification & privacy

Why do you need my ID?

When you rent without a captain you operate the vessel, so we require a photo ID from the renter before departure. It also protects both of us against fraud and payment disputes.

What happens to my ID and personal details?

Your ID is stored encrypted, is never public, and only the owner can view it. We delete it automatically 90 days after your charter. The details you give us when booking are used only for your rental agreement and your charter.

What about my card details?

We never see them. Payments are processed entirely by our payment provider (Stripe, PayPal or Square).
